View Full Version : IMPORTANT 2nd Amendment legislation!

I'm sure that our most staunch and vocal supporter of the 2nd Amendment has posted on this before, but after viewing Glenn Beck this evening, it bears repeating, and tracking, so I will be making this a Sticky.

I'm sure that some of us are familiar with the new law in Montana, formerly known as House Bill No. 246 (http://data.opi.mt.gov/bills/2009/billhtml/HB0246.htm) which states in short that any firearm, or component, made in Montana is not subject to the Interstate Commerce Clause as currently interpreted by the US government. The Bill was signed into Law by Gov. Brian Schweitzer on the 16th of April, and there are plans to immediately test the new law by having someone intentionally bait BATFEIEIO into interfering with building weapons under the new Montana law, at which point it will be immediately challenged in Federal court, with the hopes of going all the way to SCOTUS.

On Glenn Beck, he had Representatives from Utah and Texas who have introduced Legislation in their State Houses which mimic or surpass the Montana Law, and they too are hoping that their new Law (if passed in their State Legislatures) will similarly be challenged by BATFEIEIO.

Now, here's the REALLY IMPORTANT PART. If these laws are challenged by BATFEIEIO, and they go to Federal Court, it will be the biggest challenge to the Interstate Commerce Clause, perhaps ever, and if successful, it will literally overturn over 60% of the authority that the Federal government routinely, and unconstitutionally exercises over the States, from those silly low volume restrictors in your shower heads, the low consumption toilets that you have to flush a half-a-dozen times, to fuel consumption ratings in automobiles, to hourly wages, to...EVERYTHING!

If, on the other hand, the high Court once again refuses to acknowledge the very clear meaning of the Constitution, and the supremacy of States Rights, then we will see the beginning of the end of the USA as we have known it, because once again States WILL once again secede from the Union, only this time, it won't be quite as "civil" as the last Civil War, because the people that will be seceding have the guns, and the people opposing it...don't, which means that Obama will have to declare Martial Law, and utilize the REGULAR military to stop it, which will make him the new biggest mass murderer of American citizens since his hero Lincoln.

As news of these and other States proposing and/or passing similar legislation comes to our attention, please post it in this thread.

Arizona, having a 'part-time' legislature (our elected representatives - and mis-representatives - are expected to have 'real' jobs), and requires that all bills be submitted early in the session, so that despite the enthusiasm for a similar state statute, none will be forthcoming until the beginning of the new year. Our people are, however, already crafting such legislation, and lining up sponsorship - in a (nominally) conservative House, Senate, and Governor's office. The list of firearm, ammunition and allied manufacturers in Arizona goes well beyond Ruger and Cavalry Arms. This should be fun!
